Terms of Services (TOS)

By placing a commission you agree to the following TOS. Any statement can be bound to change if discussed with me, the artist, prior to the commission.I. GENERAL TERMS
Please write in a clear and nice manner. If possible, rovide neat references. Not a wall of text. Any ill behaviour will not be tolerated and your commission will be canceled if it occurs. If you fail to follow the rules provided I have the right to decline your commission.II. PAYMENT
All commissions must all be paid in full upfront via PayPal. All my prices are listen in EURO (€). Prices in other currencies may be converted at the current exchange rate.III. PROCESS
A Work In Progress will always be given if the commissioner personally asks for it and/or if the price exceeds 40€. WIPs might be given as well if I the artist need to inquire further information regarding the commission.The time for your commission to be completed can be up to 3 months depending on many factors such as: personal health, number of commissions, complexity, work or family related issues. The commissioner will be notified asap, if any of the stated issues occur.IV. CUSTOMER SATISFACTION
The satisfaction of every customer is immensely important to me. However after a commission is finished, only small changes are allowed to be made (eg. minor colouring/marking mistakes, lineart issues). Any greater changes (eg. outfit change, addition or subtraction of objects) will come with an extra charge. If your reference was unclear to start with, then you are not allowed to do minor changes without a fee.V. COPYRIGHT / USAGE POLICY
I, the artist, hold every right to the finished drawing, not the commissioner. I am therefore allowed to use the copyrighted artwork to:
- Promote myself with in any place or site
- Publish books with
- To display it anywhere to my liking
- Post it wherever I wantThe commissioner are allowed to
- Use the copyrighted artwork for personal use only unless agreed otherwise
- Print the art, and claim the right of their character(s) but not the drawing itself
- Use the art to promote themselves with proper credit given to the artistIf you break the copyright infringement in any way, every right you had to the drawing will be retracted. The following is considered Copyright infringement:
- Reproducing/using the copyrighted artwork commercially
- Taking Credit for the creation of the artwork
- Removing any watermarks/signatures
- Altering the artwork without the artist's consentA Purchase of Commercial rights to the artwork will always be 300% of original price. With commercial rights you are allowed to make any sort of merch with the artwork. Use it in books, covers, as props, change it to your liking and promote your own brand with. Credit is still required for usage of the artwork, even if altered or edited.VI. CANCELING/REFUND POLICY
I have the right to cancel and refund the money for your commission at any time. You have no right to cancel or demand a refund from the artist under any circumstances after payment are received. If money has not been sent yet the commissioner has the right to cancel the commission.If you file a chargeback against me, your right to everything I have ever made for you will be retracted and I have the right to sell the copyrighted artwork to new buyers. I have every right to file a complaint and I have all the right to the money you have given me. Any statement can be bound to change if discussed with me, the artist, prior to the commission.You agree that the artwork created for this commission is not to be altered in any fashion unless written permission by the artist is given if the artwork is shared online. (eg. cutting out the signature). You agree that the artwork being created for any and all commissions made by the artist (at any stage of completion) will not be put onto or used by any and all past, present and future blockchain-associated technologies, all past, present or future NFT marketplaces, made into NFTs or Cryptocurrencies under any circumstances.This also applies for feeding/uploading a work to any AI-driven websites for reporoducing or modifying art. This includes all past, present and future derivatives, versions, evolutions of these prior mentioned technologies, selling platforms or trading/investing spaces; this includes public or private websites and/or mobile applications. The commercial use of personal, individual use labeled commissioned artwork in any shape or form without the strict written permission by The Artist is prohibited. This includes actions performed by means such as a bot or human decision.VII. WON'T DRAW

- Non-original fandom charactersVIII. CHANGES IN TOS
It may happen that in the future I will need to update my TOS. I want to make it clear that any changes will apply to any commissions made after the updated TOS. If you received a work before the change, the old TOS still applies to you.If a TOS is updated because of a major change that impacts previous customers, I will be in contact to ask if they agree to the new TOS. If they choose not to agree we will discuss the next possible outcome.
